In exercise of the powers conferred upon me by paragraph 7(2) of Part II of Schedule 12 to the Broadcasting Act 1990(1), I hereby make the following Order:
1. This Order may be cited as the Broadcasting (Number of Houses in an Area for Purposes of Diffusion Service Licence) Order 1990 and shall come into force on 1st January 1991.
2. The number of dwelling-houses for the purposes of paragraph 7(1) (and paragraph 9(5)(b)) of Part II of Schedule 12 to the Broadcasting Act 1990 is hereby prescribed as one thousand.

Paragraph 7(1) of Part II of Schedule 12 (transitional provisions relating to existing cable services) to the Broadcasting Act 1990 disapplies certain paragraphs of that Part in respect of a licence to provide a diffusion service in an area in which there are not more dwelling-houses than the number prescribed by the Secretary of State by order. This Order exercises that power and the number 1,000 is prescribed. Paragraph 7(1) also provides that such a licence shall cease to have effect.
The number prescribed for the purposes of paragraph 7(1) also has effect for the purposes of paragraph 9(5)(b) of Part II of Schedule 12 (which also disapplies certain paragraphs of that Part).
