The Secretary of State for Social Security, in exercise of the powers conferred by sections 22(4)(h) and (5) and 30(1) of the Social Security Act 1989(1) and of all other powers enabling him in that behalf, by this instrument, which is made before the end of the period of 6 months beginning with the coming into force of the enactments under which the Regulations are made, hereby makes the following Regulations:
1. These Regulations may be cited as the Social Security (Recoupment) Amendment Regulations 1990 and shall come into force on 3rd September 1990.
2. At the end of regulation 4 of the Social Security (Recoupment) Regulations 1990(2)(exempt payments) there shall be inserted the following paragraphs-
"(e)any payment made from the Macfarlane (Special Payments) Trust established on 29th January 1990 partly out of funds provided by the Secretary of State for the benefit of certain persons suffering from haemophilia; and
(f)any payment made under the National Health Service (Injury Benefits) Regulations 1974(3)or the National Health Service (Scotland) (Injury Benefits) Regulations 1974(4)."

This instrument is made before the end of the period of 6 months beginning with the coming into force of the enactments under which the Regulations are made. The Regulations contained in this instrument are accordingly exempt by section 61(5) of the Social Security Act 1986 (c. 50), as amended by the Social Security Act 1989 (c. 24)Schedule 8, paragraph 12(3), from reference to the Social Security Advisory Committee and have not been so referred.
Regulation 2 of these Regulations amends regulation 4 of the Social Security (Recoupment) Regulations 1990 to exempt the following payments from section 22 of the Social Security Act 1989 (recovery from damages etc. of sums equivalent to benefit):-
(a)payments made from the Macfarlane (Special Payments) Trust (for haemophiliacs),
(b)payments made under the National Health Service (Injury Benefits) Regulations 1974 or the National Health Service (Scotland) (Injury Benefits) Regulations 1974 (payment of injury benefits to or in respect of persons engaged in the National Health Service in England and Wales or Scotland respectively).
