The Secretary of State for Transport, being a Minister designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the type, description, construction or equipment of vehicles, and of components of vehicles, and in particular any vehicle type approval scheme, in exercise of the powers conferred on him by the said section 2(2), and of all other enabling powers, hereby makes the following Regulations:
1. These Regulations may be cited as the Motorcycles (Sound Level Measurement Certificates) (Amendment) Regulations 1989 and shall come into force on 24th May 1989.
2. The Motorcycles (Sound Level Measurement Certificates) Regulations 1980(3) are hereby amended in accordance with the following provisions of these Regulations.
3. In paragraph (2) of regulation 4, after sub-paragraph (a) there shall be inserted-“
"(aa)the vehicle is one of a type which complies with the harmonised requirements specified in the Council Directive, and".

These Regulations further amend the Motorcycles (Sound Level Measurement Certificates) Regulations 1980, by inserting a new sub-paragraph in regulation 4(2), to make it clear that certificates are only to be issued when the relevant standards of Council Directive 78/1015/EEC as amended by Council Directive 87/56/EEC are met.
