The Secretary of State, in exercise of the powers conferred upon him by section 75 of the Copyright, Designs and Patents Act 1988 (1)("the Act"), and upon being satisfied that the bodies designated by this Order are not established or conducted for profit, hereby makes the following Order:-
1. This Order may be cited as the Copyright (Recording for Archives of Designated Class of Broadcasts and Cable Programmes) (Designated Bodies) (No. 2) Order 1989 and shall come into force on 12th February 1990.
2. Each of the bodies specified in the Schedule to this Order is designated as a body for which a recording of a broadcast or cable programme of the class designated under article 3 below, or a copy thereof, may be made for the purpose of placing the same in any archive maintained by it.
3. All broadcasts other than encrypted transmissions and all cable programmes are designated as a class for the purposes of section 75 of the Act.
4. The Copyright (Recording for Archives of Designated Class of Broadcasts and Cable Programmes) (Designated Bodies) Order 1989 (2)is hereby revoked.

Section 75 of the Copyright, Designs and Patents Act 1988 provides that copies of broadcasts or cable programmes of a designated class may be made for the purpose of being placed in an archive maintained by a designated body without infringement of copyright. The Copyright (Recording for Archives of Designated Class of Broadcasts and Cable Programmes) (Designated Bodies) Order 1989 designated two bodies and a class of broadcasts and cable programmes for the purposes of that section.
This Order re-enacts that Order with minor drafting amendments and designates two further bodies.
