1. The length of the trunk road described in the Schedule to this Order and shown by broad striped hatching on the deposited plan shall cease to be trunk road and shall be classified as a classified road as from the date on which the Secretary of State notifies the County Council of Oxfordshire that the new motorway is open for through traffic.
2. In this order:-
(1) all measurements of distance are measured along the route of the relevant highway.
(2) (i) "classified road" as a classification for a highway, means that the highway is not a principal road for the purposes of enactments or instruments which refer to highways classified as principal roads but is a classified road for the purpose of every enactment and instrument which refers to highways classified by the Secretary of State and which does not specifically refer to their classification as principal roads;
(ii)"the deposited plan" means the plan numbered HA 10/2 WMRO (L) VII marked "The A43 Oxford-Market Deeping Trunk Road (Weston-on-the-Green to South of Baynard's Green) De-Trunking Order 1989" signed by authority of the Secretary of State and deposited at the Department of Transport, Romney House, 43 Marsham Street, London SW1P 3PY;
(iii)"the trunk road" means the Oxford-Market Deeping Trunk Road (A43);
(iv)"the new motorway" means the motorway to be provided by the Secretary of State in pursuance of the M40 London-Oxford-Birmengham Motorway (Umberslade to Warwich Section) and Connecting Roads Scheme 1976(3), and the M40 London-Oxford-Birmingham Motorway (Waterstock to Warwick Section) and Connecting Roads (No. 1) Scheme 1984 (4), (No. 2) Scheme 1985(5) and (Supplementary) Scheme 1985(6).
3. This Order shall come into force on 18th December 1989 and may be cited as the A43 Oxford-Market Deeping Trunk Road (Weston-on-the-Green to South of Baynard's Green) De-Trunking Order 1989.

The length from a point 180m south-west of the junction of the A43 with a roundabout which the Secretary of State is authorised to construct pursuant to the M40; London-Oxford-Birmingham Motorway (Wendlebury to Gaydon Section Side Roads) (No. 1) Order 1985 south of Baynard's Green to the junction of the A43 with the A421 1·2km south of Weston-on-the-Green, a total distance of 10·6km.
