1. The lengths of the trunk road described in column 1 of the Schedule to this Order and shown by broad striped hatching on the deposited plan shall cease to be trunk road and shall be classified as principal road as from the date on which the Secretary of State for Transport gives notification that the new motorway between Umberslade and Warwick in the case of the lengths of the trunk road given the reference letters A and B in column 2 of that schedule, and between Warwick and Wendlebury in the case of the lengths of the trunk road given the reference letters C, D and E, is open for through traffic-
(a)in the case of the length given the reference letter A, to the Council of the Metropolitan Borough of Solihull;
(b)in the case of the lengths given the reference letters B and C, to the Warwickshire County Council;
(c)in the case of the length given the reference letter E, to the Oxfordshire County Council.
2. In this Order-
(1) all measurements of distance are measured along the route of the relevant highways;
(2) (i) "principal road" as a classification for a highway, means that the highway is a principal road for the purposes of enactments and instruments which refer to highways classified as principal roads and is also classified for the purpose of every other enactment and instrument which refers to highways classified by the Secretary of State;
(ii)"the deposited plan" means the plan numbered HA10/2 WMRO (L) VIII marked "The A34 Winchester-Preston Trunk Road (North of Oxford to Monkspath) De-Trunking Order 1989", signed by authority of the Secretary of State and deposited at the Department of Transport, Romney House, 43 Marsham Street, London SW1P 3PY;
(iii)"the trunk road" means the Winchester-Preston Trunk Road (A34);
(iv)"the new motorway" means the motorway to be provided by the Secretary of State in pursuance of the M40 London-Oxford-Birmingham Motorway (Umberslade to Warwick Section) and Connecting Roads Schemes 1976(3), and the M40 London-Oxford-Birmingham Motorway (Waterstock to Warwick Section) and Connecting Roads (No. 1) Scheme 1984(4), (No. 2) Scheme 1985(5) and (Supplementary) Scheme 1985(6).
3. This Order shall come into force on 18th December 1989 and may be cited as the A34 Winchester-Preston Trunk Road (North of Oxford to Monkspath) De-Trunking Order 1989.
