The Secretary of State for Transport, in exercise of the powers conferred by section 80(1) of the Road Traffic Act 1988(1), and of all other enabling powers, and after consultation with representative organisations in accordance with the provisions of section 195(2) of that Act, hereby makes the following regulations:
1. These Regulations may be cited as the Motor Vehicles (Designation of Approval Marks) (Amendment) Regulations 1989 and shall come into force on 14th July 1989.
2. The Motor Vehicles (Designation of Approval Marks) Regulations 1979(2) shall be further amended in accordance with the following provisions of these Regulations.
3. For paragraph (2) of regulation 3 there shall be substituted-“
"(2) A reference to a vehicle in category M1, M2, M3, N1, N2, or N3 is a reference to a vehicle described respectively as M1, M2, M3, N1, N2 or N3 in ECE Regulation 13 of 29th May 1969 as revised on 5th December 1973".
4. In Schedule 2-“
(a)after item 16 there shall be inserted item 16A as specified in the Schedule to these Regulations, and
(b)after item 44A there shall be inserted item 44B as specified in the Schedule to these Regulations.
5. In paragraph 14 of Schedule 3-“
(a)in sub-paragraph (1) for "item 16" there shall be substituted "items No. 16 and 16A",
(b)in sub-paragraph (3)(b) for sub-paragraph (iv) onwards there shall be substituted-“
"(iv)the figure "4" if the retractor is an emergency locking rectractor, or
(v)the figure and letters "4N" if the retractor is an emergency locking retractor with higher response threshold,
followed by the letter "m" if the retractor is an emergency locking retractor with multiple sensitivity.";
(c)after sub-paragraph (3), there shall be added the following sub-paragraph-“
"(4) In the case of a marking prescribed at item 16A in Schedule 2, the marking shall bear a symbol consisting of a rectangle with a motor vehicle in category M1 crossed out if the safety belt is fitted with a retractor which during normal driving conditions does not restrict the freedom of movement by the wearer of the safety belt, but has special properties as regards its use in vehicles in categories M2, M3, N1, N2 and N3".
6. In paragraph 17 of Schedule 3-“
(a)for "items No. 44 and 44A" there shall be substituted "items No. 44, 44A and 44B";
(b)in sub-paragraph (3) for the words "being either" onwards, there shall be substituted-“
"being-“
(a)in the case of a marking prescribed at item 44B-“
0-“10 kilogrammes,
0-“18 kilogrammes,
0-“25 kilogrammes,
9-“18 kilogrammes,
15-“25 kilogrammes,
22-“36 kilogrammes,
9-“25 kilogrammes, or
15-“36 kilogrammes;
(b)in any other case-“
9-“18 kilogrammes,
15-“25 kilogrammes,
22-“36 kilogrammes,
9-“25 kilogrammes, or
15-“36 kilogrammes.".

These Regulations further amend the Motor Vehicles (Designation of Approval Marks) Regulations 1979 by prescribing-“
(a)a new item numbered 16A in Schedule 2 being a marking relating to safety belts under ECE Regulation 16 as amended by ECE Regulations 16.01, 16.02, 16.03 and 16.04;
(b)a new item numbered 44B in Schedule 2 being a marking relating to child restraints under ECE Regulation 44 as amended by ECE Regulations 44.01 and 44.02.
