Whereas the West Yorkshire Residuary Body, acting pursuant to section 67(2) of the Local Government Act 1985(1), has submitted further proposals to the Secretary of State for the transfer of certain of its properties to local authorities, and he has decided to give effect to those proposals without modification:-
Now, therefore, the Secretary of State, in exercise of the powers conferred on him by section 67(3) of that Act, and of all other powers enabling him in that behalf, hereby makes the following Order:
1.-(1) This Order may be cited as the Local Government Reorganisation (Property) (West Yorkshire) Order 1988 and shall come into force on 17th May 1988.
(2) In this Order,"local council" in relation to any land means the council of the district in which the land is situated.
2. Any interest of the West Yorkshire Residuary Body in any land below a highway shall vest in the local council.
3. The land described in the Schedule, and all rights and liabilities acquired or incurred exclusively in connection with that land, shall vest in the local council.

The Local Government Reorganisation (Property) (West Yorkshire) Orders 1987 (S.I. 1987/15 and 1987/1451) transferred specified property formerly vested in West Yorkshire County Council and in the West Yorkshire Residuary Body to certain of the district councils in that County. This Order effects further transfers of the same kind.
Articles 2 and 3 transfer-
(a)the subsoil of any highway and
(b)the property described in the Schedule,
together with ancillary rights and liabilities, from the West Yorkshire Residuary Body to the council of the district in which the highway or land is situated.
