The Secretary of State for the Environment, on the application of the North West Water Authority, being statutory water undertakers(1), and in exercise of powers conferred by sections 23, 32(1) and 59(1)(2) of the Water Act 1945(3) and now vested in him(4), and of all other powers enabling him in that behalf, hereby makes the following Order:
1.-(1) This Order may be cited as the North West Water Authority (Knowsley Park Water Mains) Order 1988 and shall come into force on the 31st March 1988.
(2) The North West Water Authority (Wilmslow and Alderley Edge) Order 1988(5) and this Order shall be included among the enactments which may be cited together as the North West Water Authority Orders 1974 to 1988.
(3) In this Order-
"the Authority" means the North West Water Authority;
"the deposited plan" means the plan prepared in duplicate, signed by an Under Secretary in the Department of the Environment and marked "Plan referred to in the North West Water Authority (Knowsley Park Water Mains) Order 1988", one duplicate of which is deposited and is available for inspection at the offices of the Authority and the other at the offices of the Secretary of State for the Environment;
"the Knowsley Park Water Mains" means the water mains and associated apparatus laid in the part of the Estate of the Earl of Derby known as Knowsley Park in the Parish of Knowsley in the County of Merseyside, the approximate positions of which are shown by lines coloured red on the deposited plan;
"the undertaking" means the water undertaking of the Authority as for the time being authorised by any enactment.
2.-(1) The Authority may acquire by agreement the Knowsley Park Water Mains or any part thereof, and may continue and maintain any pipes and apparatus so acquired.
(2) Any parts of the Knowsley Park Water Mains acquired by the Authority in pursuance of this Order shall for all purposes form part of the undertaking.
3. Section 94(6) of the Third Schedule to the Water Act 1945 (copies of special Act to be kept by undertakers in their office, and deposited with certain officers) shall apply to the undertaking and is hereby incorporated with this Order.
