In exercise of the powers conferred by section 46(1) of the Education Reform Act 1988(1), the Secretary of State for Education and Science hereby makes the following Order:
1. This Order may be cited as the Education (Amendment of the Teachers' Pay and Conditions Act 1987) Order 1988 and shall come into force on 31st December 1988.
2. At the end of paragraph (a) of section 3(5) of the Teachers' Pay and Conditions Act 1987(2) there shall be added the words "and provide for any discretion so conferred on a local education authority to be exercisable instead by the governing body of any school to which section 44 or 45 of the Education Reform Act 1988 for the time being applies".

This Order amends section 3(5)(a) of the Teachers' Pay and Conditions Act 1987 to enable any Order made under that section to provide for any discretion conferred on a local education authority by virtue of that paragraph to be exercisable instead by the governing body of any school to which section 44 or 45 of the Education Reform Act 1988 (staff employed in schools with a delegated budget) for the time being applies.
