The Secretary of State for Transport, in exercise of the powers conferred by section 19(8) of the Transport Act 1981(1) and of all other enabling powers, hereby makes the following Order:-
1.-(1) This Order may be cited as the Penalty Points (Alteration) Order 1988 and shall come into force on 1st March 1989.
(2) In this Order, "the 1972 Act" means the Road Traffic Act 1972(2).
2. In Part II of Schedule 7 to the Transport Act 1981 (Penalty Points) the following alterations shall be made-
(a)in the entry relating to section 3 of the 1972 Act (careless or inconsiderate driving), for "2-5" there shall be substituted "3-9";
(b)in the first entry relating to section 25(4) of the 1972 Act (failing to stop after accident), for "5-9" there shall be substituted "8-10";
(c)in the second entry relating to section 25(4) of the 1972 Act (failing to give particulars or report accident), for "4-9" there shall be substituted "8-10"; and
(d)in the entry relating to section 143 of the 1972 Act (using, or causing or permitting use of, motor vehicle uninsured or unsecured against third party risks), for "4-8" there shall be substituted "6-8".
3. This Order shall not apply to-
(a)an offence committed before 1st March 1989, or
(b)an offence under section 25(4) of the 1972 Act relating to an accident occurring before that date.
