The Secretary of State, in exercise of the powers conferred on him by sections 19 and 108(1) of the National Health Service (Scotland) Act 1978((1)), and of all other powers enabling him in that behalf, hereby makes the following Regulations:
1.-(1) These Regulations may be cited as the National Health Service (General Medical and Pharmaceutical Services) (Scotland) Amendment (No.2) Regulations 1988 and shall come into force on 7th September 1988.
(2) In these Regulations "the principal Regulations" means the National Health Service (General Medical and Pharmaceutical Services) (Scotland) Regulations 1974((2)).
2. In Schedule 4 to the principal Regulations (list of prescribed medical certificates)((3)) there shall be inserted the following:-
(a)in the column headed "Medical Certificate" the words-
"13. To support claim by or on behalf of a severely mentally impaired person for exemption from liability to pay the personal community charge.";
(b)in the column headed "Short title of enactment under or for the purpose of which certificate required", and opposite item 13 above mentioned, the words-
"Abolition of Domestic Rates Etc. (Scotland) Act 1987 (1987 c. 47)."((4)).

These Regulations amend the National Health Service (General Medical and Pharmaceutical Services) (Scotland) Regulations 1974 ("the principal Regulations") which regulate the terms upon which doctors provide general medical services under the National Health Service in Scotland.
The amendment relates to the introduction of the community charge under the Abolition of Domestic Rates Etc. (Scotland) Act 1987, and takes effect on 7th September 1988.
Schedule 4 to the principal Regulations lists the certificates which a doctor must, in accordance with paragraph 10(5) of Schedule 1 to the principal Regulations, issue free of charge, and the enactments under or for the purpose of which such certificates are required. These Regulations add to Schedule 4 a certificate to support a claim for exemption from liability to pay the personal community charge in respect of a severely mentally impaired person, and the Abolition of Domestic Rates Etc. (Scotland) Act 1987.

Schedule 4 was amended by S.I. 1976/1574, 1982/1279, 1987/386 (all amending item 1), and by S.I. 1985/1625 (inserting item 12).
Section 8(8) and (9) of 1987 c. 47 (which concerns liability for personal community charge) was amended by the Local Government Finance Act 1988 (c. 41), section 129; Schedule 1A to 1987 c. 47 (which concerns exemption from liability to pay such charge) was inserted by the Local Government Finance Act 1988, Schedule 12, paragraph 35.
