The Lord Chancellor, in exercise of the powers conferred on him by section 20(2) of the Sheriffs Act 1887(1), with the advice and consent of the Judges of the Court of Appeal and the High Court and with the concurrence of the Treasury, hereby makes the following Order:-
1.-(1) This Order may be cited as the Sheriffs' Fees (Amendment) Order 1988 and shall come into force on 1st October 1988.
(2) In this Order-
"the Order of 1920" means the Order made under section 20(2) of the Sheriffs Act 1887 and dated 8th July 1920, as amended(2);
"the Order of 1921" means the Order made under the said section 20(2) and dated 2nd May 1921, as amended(3).
2. In Fee No. 1 in the Table of Fees set out in the Schedule to the Order of 1920, for the words "22.3 pence" there shall be substituted the words "29.2 pence".
3. In Fee No. 7A in the Table of Fees set out in Part I of the Schedule to the Order of 1921, for the words "22.3 pence" there shall be substituted the words "29.2 pence".
4. In Fee No. 8 in the Table of Fees set out in Part I of the Schedule to the Order of 1921, for the words "£1" there shall be substituted the words "£5".

This Order increases the mileage fee payable to sheriffs on execution of writs of fieri facias, possession or delivery from 22.3 to 29.2 pence per mile and increases the fee payable to sheriffs for a copy of a return on a writ of execution from £1 to £5.
