The Secretary of State, being a Minister designated(2) for the purposes of section 2(2) of the European Communities Act 1972(3) in relation to provisions concerning the composition, labelling, marketing, classification or description of textiles and products incorporating textiles, in exercise of the powers conferred on him by that section and of all other powers enabling him in that behalf, hereby makes the following Regulations:-
1. These Regulations may be cited as the Textile Products (Indications of Fibre Content) (Amendment) Regulations 1988 and shall come into force on 1st September 1988.
2. The Textile Products (Indications of Fibre Content) Regulations 1986(4) are hereby amended as follows:-
(a)at the end of regulation 9(a) there shall be added the words "to any destination except a destination in another member State";
(b)in Part I of Schedule 2, in Column 1 of entry 20, for the word "model" there shall be substituted the word "modal"; and
(c)in Schedule 3-
(i)in item 1-2, for the word "combined" there shall be substituted the word "combed";
(ii)in items 1-2 and 3 for "17.00" there shall be substituted
"17.00(1)", and the following shall be added at the bottom of the first page of the Schedule:-
(iii)for item 28 there shall be substituted the following:-
"Polyamide or nylon: | |
| 6.25 |
| 5.75"; and |
(iv)in item 38, for the words "filament with a" there shall be substituted the words "with an average" in both cases that they occur.

These Regulations amend the Textile Products (Indications of Fibre Content) Regulations 1986 ("the principal Regulations") which require that when textile products are supplied or offered for supply commercially or are described in certain advertisements an indication of their fibre content shall be given.
In order to implement Commission Directive 87/140/EEC (OJ No. L56, 26.2.87, p.24) the main change is that a single agreed allowance is to be applied for calculating the composition of combed or carded fibres containing wool and animal hair or animal hair only, where it is impossible to ascertain whether the hair is combed or carded.
Minor corrections are made to the principal Regulations to ensure that they comply with the Directive implemented by those Regulations.
