Whereas the Charity Commissioners for England and Wales have, in pursuance of subsection (1) of section 19 of the Charities Act 1960(1), settled the Scheme set out in the Appendix to this Order with a view to its being given effect under that section:
And Whereas the said Scheme does not alter any statutory provision contained in or having effect under any public general Act of Parliament:
And Whereas a draft of this Order has been laid before Parliament and the period of forty days mentioned in section 6(1) of the Statutory Instruments Act 1946(2) has expired and neither House of Parliament has within that period resolved that the Order be not made:
Now, therefore, in pursuance of section 19(2) of the Charities Act 1960, I hereby make the following Order:-
1. This Order may be cited as the Charities (University of Liverpool) Order 1988 and shall come into force on the fourteenth day after the day on which it is made.
2. The Scheme set out in the Appendix to this Order shall have effect.

Whereas the Charity known as the University of Liverpool is regulated by:
(1) a Royal Charter of the 15th July 1903;
(2) the Liverpool University Act 1903(3);
(3) the Liverpool University Act 1931(4); and
(4) a supplemental Royal Charter of the 1st August 1961:
And Whereas the Charity has made application to the Charity Commissioners for a Scheme for the administration thereof:
And Whereas it appears to the Charity Commissioners that a Scheme should be established for the administration of the Charity but that it is necessary for the Scheme to alter the provision made by the said Act of 1931:
And whereas in pursuance of section 21 of the Charities Act 1960 public notice of the Charity Commissioners' proposals for this Scheme has been given and no representations have been received by the Charity Commissioners in respect thereof:
Now, therefore, the Charity Commissioners for England and Wales, in pursuance of section 19(1) of the Charities Act 1960, hereby settle the following Scheme:-
Any gift to the above-mentioned Charity (whether for its general purposes or for any specific purpose or purposes thereof) in which the interest of the Charity is created after this Scheme takes effect shall be administered in accordance with the trusts of that gift and shall not be added to the fund established and regulated by the Liverpool University Act 1931 (therein and hereinafter referred to as the University Fund) unless the donor shall, by the deed or other instrument of gift, expressly stipulate that such gift is to form part of the University Fund, and sections 4 and 5 of that Act (which require certain future gifts made to the Charity to be added to the University Fund) shall not have effect in relation to any gift which, by virtue of the provisions of this Scheme, is not added to the University Fund.

This Order gives effect to a Scheme of the Charity Commissioners in respect of the University of Liverpool. Under the Liverpool University Act 1931 certain future gifts made to the University are required to be added to a consolidated fund established and regulated by that Act. The Scheme modifies those statutory requirements so that a gift is added to that fund only where the donor of the gift has expressly stipulated that the gift is to form part of the fund.
