CHRONICALLY SICK AND DISABLED PERSONS

The Secretary of State for Scotland, in exercise of the powers conferred upon him by section 18(2) of the Disabled Persons (Services, Consultation and Representation) Act 1986(1), and of all other powers enabling him in that behalf, hereby makes the following Order:
1.-(1) This Order may be cited as the Disabled Persons (Services, Consultation and Representation) Act 1986 (Commencement No. 3) (Scotland) Order 1987.
(2) This Order shall apply only to Scotland.
(3) In this Order"the Act" means the Disabled Persons (Services, Consultation and Representation) Act 1986.
2.-(1) The provisions of the Act specified in column 1 of Schedule 1 to this Order (which relate to the matters specified in column 2 thereof) shall come into force on 1st June 1987.
(2) The provisions of the Act specified in column 1 of Schedule 2 to this Order (which relate to the matters specified in column 2 thereof) shall come into force on 1st October 1987.

This Order brings into force in Scotland on 1st June 1987 certain sections of the Disabled Persons (Services, Consultation and Representation) Act 1986, namely section 9 (which amends section 1(2) of the Chronically Sick and Disabled Persons Act 1970 in relation to provision of information by local authorities), section 10 (which provides for consultation with organisations of disabled people before making appointments or co-options to certain bodies), section 11 (which provides for reports to be made to Parliament by the Secretary of State), section 12 (which amends section 29(2) of the Chronically Sick and Disabled Persons Act 1970 and section 2 of the Social Work (Scotland) Act 1968), section 14 (which amends the Education (Scotland) Act 1980 (c. 44) with regard to assessment and recording of children and young persons), section 16 (which provides for interpretation of the Act), section 17 (which provides for finance) and section 18 (which provides for the short title, commencement and extent of the Act and for procedural requirements for regulations and orders under it).
This Order also brings into force in Scotland on 1st October 1987 sections 4 except paragraph (b) and 8(1) of the 1986 Act (which respectively impose duties on a local authority to consider the needs of disabled persons when requested to do so by certain specified persons, and to take into account the abilities of the carer to continue to provide care to a disabled person).
