The Secretary of State, in exercise of the powers conferred upon him by section 26 of the Police (Scotland) Act 1967((1)) and of all other powers enabling him in that behalf, and after taking into consideration the recommendations made by the Police Negotiating Board for the United Kingdom and furnishing the said Board with a draft of the Regulations in accordance with section 2(1) of the Police Negotiating Board Act 1980((2)), hereby makes the following Regulations:
1. These Regulations may be cited as the Police (Scotland) Amendment Regulations 1987.
2. These Regulations shall come into force on 13th April 1987 and shall have effect for the purposes of regulation 5(1)(c) as from 23rd April 1986, for the purposes of regulations 7 and 10 as from 1st July 1986 and for the purposes of regulations 6, 8 and 9 as from 1st September 1986.
3. In these Regulations any reference to "the principal Regulations" is a reference to the Police (Scotland) Regulations 1976((3)).
4.-(1) In regulation 1 of the principal Regulations (citation, commencement and interpretation) there shall be inserted in paragraph 2(g) in the appropriate place the following definition:–
""rostered rest day" has the meaning assigned by regulation 21A;".
(2) In regulation 21A of the principal Regulations (rostering of duties for lower ranks) there shall be added the following paragraph:–
"(6) In these regulations–
(a)a reference to a rostered rest day, in relation to a constable who is required to do duty on that day, is a reference to a day which according to the duty roster was, immediately before he was so required to do duty, to have been a rest day for the constable; and
(b)a day off granted in lieu of a rostered rest day shall be treated as a rostered rest day.".
(3) In regulation 23 of the principal Regulations (public holidays and rest days for lower ranks), paragraph (7)(e) is deleted.
5.-(1) In Schedule 2 to the principal Regulations (annual leave)–
(a)in paragraph 1(1)–
(i)after the words "every constable" there shall be inserted the words "of or above the rank of superintendent"; and
(ii)in the Table the entries relating to ranks below the rank of superintendent shall be deleted;
(b)after paragraph 1(1) there shall be inserted the following:–
"(1A) Subject as aforesaid, every constable holding a rank below that of superintendent shall be granted in each leave year commencing after 31st December 1986 the period of leave set out opposite his relevant service in the Table below: Provided that a constable whose annual leave entitlement, immediately before the coming into force of this paragraph in respect of the first leave year commencing after 31st December 1986, exceeded the period prescribed in his case in respect of that year by the foregoing provisions of this paragraph shall continue to be entitled to be granted such greater period of leave until such time as he shall have completed such number of years' relevant service as, by virtue of the said provisions, entitle him to an increased period of leave.

(c)in paragraph 3C–
(i)the words "an additional", in each place where they occur, shall be omitted; and
(ii)for the words "in respect of", in each place where they occur, there shall be substituted the words "in lieu of".
(2) In relation to any constable to whom it applies, paragraph (1)(a) of this regulation shall have effect from the beginning of the first leave year commencing on or after 31st December 1986.
6. In Schedule 3 to the principal Regulations (scales of pay) for Tables A and B there shall be substituted respectively Tables A and B set out in the Schedule to these Regulations.
7. In paragraph 3(2) of Schedule 9 to the principal Regulations (university scholars), for the sum "£885" there shall be substituted the sum "£945".
8. In paragraph 1(1) of Schedule 10 to the principal Regulations (dog handler's allowance) for the sums "£528" and "£717" there shall be substituted respectively the sums "£567" and "£771".
9. Regulations 6 and 8 of the Police (Scotland) Amendment (No. 3) Regulations 1985((4)) (scales of pay and dog handler's allowance) are revoked.
10. Regulation 6 of the Police (Scotland) Amendment Regulations 1986((5)) (university scholars) is revoked.

These Regulations further amend the Police (Scotland) Regulations 1976 ("the principal Regulations"). They come into force on 13th April 1987 and have effect for the purposes of regulation 5(1)(c) as from 23rd April 1986, for the purposes of regulations 7 and 10 as from 1st July 1986 and for the purposes of regulations 6, 8 and 9 as from 1st September 1986 (retrospection is authorised by section 26(3) of the Police (Scotland) Act 1967).
Regulation 4 provides that references in the principal Regulations to a rostered rest day include a leave day granted in lieu.
Regulation 5(1)(a) and (b) and (2) provides that all constables up to and including the rank of chief inspector shall have the same leave entitlement (commensurate with their length of service) in each leave year commencing on or after 31st December 1986. Existing entitlements, where better, are preserved.
Regulation 5(1)(c) rectifies an ambiguity in the provision made by the Police (Scotland) Amendment Regulations 1986 whereby a constable recalled to duty during a period of annual leave is entitled to compensatory annual leave in lieu.
Regulations 6 and 8 provide for increases of pay for police constables up to and including the rank of chief inspector and of the dog handler's allowance.
Regulation 7 increases from £885 to £945 the supplement payable to an officer of a Scottish police force who takes up residence as a university scholar in London.
Regulations 9 and 10 make consequential revocations.
