The Secretary of State for Transport, in exercise of the powers conferred by section 50(1) of the Road Traffic Act 1972(1), now vested in him(2), and of the powers conferred by section 56(1) of the Finance Act 1973(3) with the consent of the Treasury, and of all other enabling powers, and in relation to the exercise of the powers conferred by section 50(1) of the Road Traffic Act 1972, after consultation with representative organisations in accordance with section 199(2) of that Act, hereby makes the following Regulations:–
1. These Regulations may be cited as the Motor Vehicles (Type Approval and Approval Marks) (Fees) (Amendment) Regulations 1987 and shall come into force on 1st April 1987.
2. The Motor Vehicles (Type Approval and Approval Marks) (Fees) Regulations 1984(4) are hereby further amended in accordance with the following provisions of these Regulations.
3. In regulation 4 (Fees-basic scale for examinations of vehicles or parts of vehicles), in paragraph (2) for the words "column 2" there shall be substituted the words "column 1".
4. In regulation 8 (Fees-final examination of complete vehicle), in paragraph (2)(c) for sub-paragraph (ii) there shall be substituted–
"(ii)in column (3)(b) of Schedule 3 if the vehicle is in category N2, and
(iii)in column (3)(c) of Schedule 3 if the vehicle is in category N3.".
5. In regulation 13 (Fees on withdrawals and cancellations), for paragraph (1) there shall be substituted–
"(1) Subject to the provisions of regulation 14, if an applicant:–
(a)after he has been notified of the time and place for the examination withdraws his application, or
(b)does not submit the vehicle or vehicle part for the examination at the time and place fixed therefor,
he shall be liable to pay a cancellation fee to cover the abortive work involved in dealing with the application and making arrangements for the examination:–
(i)in the case of an examination of a vehicle or vehicle part to which a fee specified in regulation 5 or Schedule 1 applies–
(A)of £66, if the Secretary of State is notified of the withdrawal or of the intention not to submit the vehicle or vehicle part for the examination not less than 7 days before the date fixed for the examination, or
(B)in any other case-
(aa)where the fee is specified in column (a) of Schedule 1, of a quarter of that fee plus any wasted expenses reasonably incurred by the Secretary of State in the provision of any facility for the particular examination, or
(bb)where the fee is specified in regulation 5 or column (b) of Schedule 1, of half that fee or £150 if that is less;
(ii)in the case of a further or partial examination of a vehicle or vehicle part in the circumstances described in regulation 7, of such proportion of the fee as the Secretary of State considers to be appropriate;
(iii)in the case of an examination of a vehicle to which a fee specified in Schedule 2 or Schedule 3 applies–
(A)of £66, if the Secretary of State is notified of the withdrawal or of the intention not to submit the vehicle for examination not less than 14 days before the date fixed for the examination, or
(B)of £200 in any other case.".
6. In the regulations listed in column 1 of the table below there shall be substituted for the present fees listed in column 2 in relation to those regulations the new fees listed in column 3 of the table.

7. For Schedules 1 to 5 there shall be substituted the schedules contained in the Schedule to these Regulations.

1. These Regulations further amend the Motor Vehicles (Type Approval and Approval Marks) (Fees) Regulations 1984 in the following ways–
(a)regulation 3 corrects an error in regulation 4(2) of the principal Regulations;
(b)regulation 4 amends regulation 8(2)(c)(ii) so as to distinguish between fees applied to vehicles in category N2 and those in category N3;
(c)regulation 5 amends regulation 13 and restructures the fees payable on withdrawals and cancellations. The new structure prescribes a cancellation fee of £66–
(i)if the Secretary of State is notified not less than 7 days before the date fixed for the examination of the withdrawal or of the intention not to submit a vehicle or vehicle part for an examination in relation to which a fee in regulation 5 or Schedule 1 applies, or
(ii)if the Secretary of State is so notified not less than 14 days before the date fixed for the final examination of a vehicle in relation to which a fee in Schedule 2 or Schedule 3 applies.
The cancellation fees in other cases are-
where the examination fee is specified in column (a) of Schedule 1, a quarter of that fee plus any wasted expenses incurred by the Secretary of State;
where the examination fee is specified in regulation 5 or column (b) of Schedule 1, a half of that fee or £150 if less;
where the examination fee is specified in Schedule 2 or 3, £200; and
where a partial examination under regulation 7 is involved, such proportion of the fee as the Secretary of State considers to be appropriate;
regulation 6 amends regulations 5, 6, 11 and 15 and increases the fees payable for certain examinations, towards certain expenses, and when particulars and notifications are sent to the Secretary of State; and
regulation 7 substitutes new Schedules for Schedules 1 to 5 to the principal Regulations. Almost 75% of the fees are increased by varying amounts, almost equally in the ranges of 0–20% and 20–50% but with a small number increasing by amounts greater than 50%. A small number of fees remain unchanged or are new fees. The remaining fees are decreased by varying amounts, mostly in the range of 0–20%.
