The Secretary of State for Transport, being a Minister designated(1) for the purpose of section 2(2) of the European Communities Act 1972(2) in relation to the regulation and supervision of the working conditions of persons engaged in road transport, in exercise of the powers conferred by that section, hereby makes the following Regulations:
1. These Regulations may be cited as the Community Drivers' Hours (Passenger and Goods Vehicles) (Temporary Exception) Regulations 1987 and shall come into force on 17th January 1987.
2. Pursuant to Article 13(2) of Council Regulation (EEC) No. 3820/85 of 20th December 1985 on the harmonisation of certain social legislation relating to road transport(3) until 16th February 1987 that Regulation shall apply to transport operations to which it applies with the exception of Articles 6, 8 and 9.

Article 13(2) of Council Regulation (EEC) No. 3820/85 of the 20th December 1985 on the harmonisation of certain social legislation relating to road transport provides that Member States may in urgent cases grant a temporary exception for a period not exceeding 30 days to transport operations carried out in exceptional circumstances. These Regulations provide that until the 16th February 1987 the Regulation shall apply to transport operations to which it applies with the exception of Articles 6, 8 and 9. The exceptional circumstances for the making of the Regulations are the severe weather conditions and the effects and consequences of the severe weather conditions.
