The Treasury, in exercise of the powers conferred upon the Minister for the Civil Service by section 5(2) of the Pensions (Increase) Act 1971, and now vested in them(1), and of all other powers enabling them in that behalf, hereby make the following regulations:-
1. These regulations may be cited as the Pensions Increase (Local Authorities' etc. Pensions) (Amendment) Regulations 1986, and shall come into operation on 1st April 1986.
2. Regulation 4 of the Pensions Increase (Local Authorities' etc. Pensions) Regulations 1974(2) is amended-
(a)in paragraph (1), by inserting after the words "they shall" the words ", subject to paragraph (1C),"; and
(b)by inserting after paragraph (1B) the following:
"(1C) In the case of a pension specified in paragraph 1 of the Schedule to these regulations which is payable in respect of service ending with service under a public transport company within the meaning of Part IV of the Transport Act 1985(3), the authority by whom the pension is payable shall be reimbursed by the body which, when the company was formed, was its controlling authority within the meaning of that Part the cost of any increase of pension payable by virtue of these regulations.".

These regulations amend the Pensions Increase (Local Authorities' etc. Pensions) Regulations 1974 so as to secure that the cost of increasing certain pensions is borne by appropriate authorities. The pensions are those which become payable by local authorities, out of superannuation funds administered under the Local Government Superannuation Regulations 1986 (S.I. 1986/24), in respect of service under public transport companies formed, by local and other authorities, under Part IV of the Transport Act 1985. The cost is to be borne by the authority by whom the company was formed.
