The Minister of Agriculture, Fisheries and Food in relation to England and the marine waters adjacent to England, the Secretary of State for Wales in relation to Wales and the marine waters adjacent to Wales and the Secretary of State for Scotland in relation to Scotland (including the marine waters thereof), in exercise of the powers conferred on them by section 1(6) of the Diseases of Fish Act 1937(1) and of all other powers enabling them in that behalf, hereby make the following order, a draft of which has been approved by resolution of each House of Parliament in accordance with section 1(9) of the said Act:-
1. This order may be cited as the Importation of Live Fish of the Salmon Family Order 1986 and shall come into operation on the day after the day on which it was made.
2. Live fish of the salmon family which have been taken from Northern Ireland and have not at any time been in any country or territory outside Northern Ireland are hereby specified for the purposes of section 1(6) of the Diseases of Fish Act 1937.

This order specifies a description of live fish of the salmon family, namely, fish which have been taken from Northern Ireland and have never been in any country or territory outside Northern Ireland, for the purpose of excluding fish of that description from section 1(1) of the Diseases of Fish Act 1937 ("the Act"), which would otherwise make it unlawful to import or bring into Great Britain any live fish of the salmon family.
By virtue of the order and section 1(8) of the Act, it is lawful to import or bring into Great Britain fish of the specified description provided that the licensing provisions contained in section 1(2) to (5) of the Act are satisfied.
section 1(1) was amended, and section 1(6) to (10) was inserted, by section 1 of the Diseases of Fish Act 1983 (c.30); section 1(2) was amended by paragraph 12 of Schedule 4 to the Customs and Excise Management Act 1979 (c.2); section 1(3) was amended by paragraph 1 of the Schedule to the Diseases of Fish Act 1983.
