The Lord Chancellor and the Secretary of State for Social Services, in exercise of the powers conferred on them by section 88(1) and (2) of the Social Security Act 1986(1), and of all other powers enabling them in that behalf, hereby make the following order:-
1.-(1) This order may be cited as the Social Security Act 1986 (Commencement No. 3) Order 1986.
(2) In this order unless the context otherwise requires, references to sections and Schedules are references to sections of, and Schedules to, the Social Security Act 1986.
2.-(1) Subject to paragraph (2) of this article, the day appointed for the coming into force of section 52 and Schedule 5 (adjudication) is 6th April 1987.
(2) The following provisions of paragraph 7 of Schedule 5 (appeal from social security appeal tribunals to Commissioners) shall not have effect in relation to any decisions of social security appeal tribunals which are recorded in writing before the appointed day:-
(a)paragraph 7(1);
(b)paragraph 7(3) in so far as it substitutes a new subsection (5A) for subsection (5) of section 101 of the Social Security Act 1975(2).
3. The day appointed for the coming into force of section 82 and Schedule 9 (amendments of enactments relating to social security in Northern Ireland) shall be the 6th April 1987.

Articles 2 and 3 of this order appoint 6th April 1987 for the coming into force of section 52 of the Social Security Act 1986 and Schedule 5 (adjudication) and also section 82 and Schedule 9 (amendments of enactments relating to social security in Northern Ireland). The bringing into operation of section 52 and Schedule 5 does not affect rights of appeal from decisions of social security appeal tribunals recorded in writing before the appointed day. Section 52 will have effect in relation to statutory maternity pay and social fund payments for maternity and funeral expenses on 6th April 1987 since those benefits are brought into existence on that day by the Social Security Act 1986 (Commencement No. 4) Order 1986 (S.I. 1986/1959) but it will have no practical effect in relation to income support and family credit until such benefits are brought into existence by a further order.

section 83(1) provides for section 166(1) to (3A) of the Social Security Act 1975 (c.14) (extent of powers) to apply to the powers conferred by section 88(1) and (2).
section 101 was amended by the Social Security Act 1980 (c.30), Schedule 1, paragraph 10 and by the Health and Social Services and Social Security Adjudications Act 1983 (c.41), Schedule 8, paragraph 1.
