Her Majesty, by and with the advice of Her Privy Council, and by virtue of the authority conferred upon Her by sections 31 and 47 of the Copyright Act 1956 and of all other powers enabling Her in that behalf, is pleased to direct, and it is hereby directed, as follows:-
1. This Order may be cited as the Copyright (Bermuda) (Amendment) Order 1985 and shall come into operation on 1st February 1986.

(a)after the words "and the Films Act 1960(b)" and before the words "except section 8," are added the words "the Copyright Act 1956 (Amendment) Act 1982" "and the Copyright (Amendment) Act 1983,"; and
(b)after the words "except section 8," and before the words "sections 23 to 30," are added the words "section 21B,".
3. The table in Part II of the First Schedule to the principal Order is amended so as to further modify sections 18 and 21 and to insert a new provision, section 21A, as follows:

Section 18 | After the entry for subsection (1) and before the entry for subsection (4), add a new entry relating to subsection (3):- "in subsection (3) in the definition of "plate" appearing at the end thereof, there shall be inserted after the word "appliance", the words "and any machine, device or equipment."". |
Section 21 | After the entry for subsections (1) and (6) and before the entry for subsection (10) add the following entries:- "subsections (7) and (8) shall be omitted and replaced by the following:- "(7) A person guilty of an offence under this section shall be liable- (a)on summary conviction, to a fine not exceeding five thousand dollars or to imprisonment for a term not exceeding six months or both; (b)on conviction on indictment, to a fine not exceeding twenty-five thousand dollars or to imprisonment for a term not exceeding five years or to both.";
subsections (7A), (7B), (7C) and (7D) shall be omitted;" |

This Order amends the Copyright (Bermuda) Order 1962 so as to modify section 18 of the Copyright Act 1956 in its application to Bermuda and to extend section 21 of the Copyright Act 1956 as amended by the Copyright Act 1956 (Amendment) Act 1982 and the Copyright (Amendment) Act 1983 and section 21A of the Copyright Act 1956 as inserted by the Copyright (Amendment) Act 1983, with certain exceptions and modifications set out in Articles 2 and 3 of this Order, to form part of the law of Bermuda.
to which there are amendments not relevant to this Order.
