The Lord Chancellor, in exercise of the powers conferred on him by sections 3(4) and 14(1) of the Public Trustee Act 1906, and with the concurrence of the Treasury, hereby makes the following Rules:-
1. These Rules may be cited as the Public Trustee (Amendment) Rules 1983 and shall come into operation on 15th August 1983.
2. The Public Trustee Rules 1912 shall be amended as follows:-
(1) In rule 15-
(a)the words "in manner hereinafter provided and" shall be omitted from paragraph (1).
(b)The following shall be substituted for paragraphs (2) and (3):-
"(2) Any such question shall be submitted-
(a)to such Judge of the Chancery Division as the Vice-Chancellor may specify; and
(b)in such manner as that judge may direct."
(2) In rule 22, after the word "cheque" where it first appears, the words "on the Bank of England bearing a signature or a facsimile signature of an officer of the Public Trustee authorised in writing by him to act in that behalf or a cheque" shall be inserted.

These Rules-
(a) dispense with the formal nomination of a Judge of the Chancery Division to advise upon questions referred to him by the Public Trustee in the course of the administration of a trust; and
(b) provide for the signature or facsimile signature of an officer authorised by the Public Trustee to be placed on cheques making payments to beneficiaries.
