The Secretary of State for Transport, in exercise of the powers conferred by section 63(1) of the Road Traffic Act 1972(1) and now vested in him(2), and of all other enabling powers, and after counsultation with representative organisations in accordance with the provisions of section 199(2) of that Act, hereby makes the following Regulations:-
1. These Regulations shall come into operation on 4th January 1982 and may be cited as the Motor Vehicles (Designation of Approval Marks) (Amendment) (No. 2) Regulations 1981.
2. The Motor Vehicles (Designation of Approval Marks) Regulations 1979(3) are amended in accordance with the following provisions of these Regulations.
3. After Regulation 5 add the following new Regulation:-
"6. The Secretary of State for Transport hereby designates as an approval mark in respect of a replacement exhaust system to which Commission Directive 81/334/EEC (4) relates, or any component of such a system (other than fixing hardware and pipes) a clearly legible and indelible marking consisting of-
(a)the trade mark or trade name of the manufacturer of the system or, as the case may be, the component;
(b)the manufacturer's commercial description of the system or, as the case may be, the component;
(c)the distinctive letters of the Member State whose competent authority granted type approval of the system or, as the case may be, the component as indicated in the footnote relating to paragraph 3.1.3 of Annex II of the said Commission Directive; and
(d)the number of the certificate given by the competent authority of a Member State in accordance with paragraph 4.1 of Annex II of the said Commission Directive.".
4. In Schedule 2:-
(a)after item 11A, insert the following new item:-
"11B | Motor vehicle approved in respect of side door latches and hinges. | The vehicle | 11 (amendment, 15th March 1981) | 1 and 2"; |
(b)after item 17A, insert the following new item:-
"17B | Motor vehicle approved in respect of the strength of the seats and their anchorages. | The vehicle | 17 (amendment, 9th March 1981) | 1 and 2"; |
(c)after item 18, insert the following new item:-
"18A | Motor vehicle approved in respect of protection against unauthorised use. | The vehicle | 18 (amendment, 24th November 1981) | 1 and 2" |
; and
(d)after item 21, insert the following new item:-
"21A | Motor vehicle approved in respect of its interior fittings. | The vehicle | 21 (amendment, 8th October 1980) | 1 and 2". |
5. In Schedule 4, after item 28, add the following new item:-
"29 | Rear-view mirror for two-wheeled motor vehicles. | The rear-view mirror | Council Directive 80/780/EEC of 22nd July 1980 | O.J. L229, 30.8.80, p. 49 | 1 and 2". |

1. These Regulations further amend the Motor Vehicles (Designation of Approval Marks) Regulations 1979 so as to-
(a) designate as approval marks the markings shown in column (2) in the new items numbered 11B, 17B, 18A and 21A in Schedule 2 to the Regulations so as to take account, respectively, of amendments to ECE Regulations 11 (Uniform provisions concerning the approval of vehicles with regard to door latches and hinges), 17 (Uniform provisions concerning the approval of vehicles with regard to the strength of the seats and of their anchorages), 18 (Uniform provisions concerning the approval of power-driven vehicles with regard to their unauthorised use) and 21 (Uniform provisions concerning the approval of vehicles with regard to their interior fittings);
(b) designate as an approval mark the marking shown in column (2) in the new item numbered 29 in Schedule 4 to the Regulations, which marking, pursuant to Council Directive 80/780/EEC of 22nd July 1980 on the approximation of the laws of the Member States relating to rear-view mirrors for two-wheeled motor vehicles with or without a side-car and to their fitting on such vehicles, indicates that the rear-view mirror to which it is attached is of a type approved in accordance with the requirements specified in that Directive; and
(c) designate as an approval mark in respect of a replacement exhaust system to which Commission Directive 81/334/EEC relates, or a component of such a system, a marking consisting of the features mentioned in sub-paragraphs (a) to (d) of the new Regulation numbered 6.
2. Copies of the ECE Regulations and EEC Directives mentioned above may be obtained from Her Majesty's Stationery Office.
