The Secretary of State in exercise of the powers conferred on him by section 7 of the Trade Union (Amalgamations, etc.) Act 1964 and section 8(4) of the Trade Union and Labour Relations Act 1974 and of all other powers enabling him in that behalf, and as respects Regulation 4 with the approval of the Treasury, hereby makes the following Regulations amending the
1.-(1) These Regulations may be cited as the Trade Unions and Employers' Associations (Amalgamations, etc.) (Amendment) Regulations 1978 and shall come into operation on 1st November 1978.
(2) The Interpretation Act 1889 applies to the interpretation of these Regulations as it applies to an Act of Parliament.
2. In Regulation 2(2) of the principal Regulations, the definition of "the Registrar" shall be deleted and the following definition substituted:-
"-˜the Certification Officer' means
3. In the principal Regulations for the expression "the Registrar", wherever it occurs, there shall be substituted the expression "the Certification Officer".
4. For Regulation 11 of the principal Regulations there shall be substituted the following Regulation:-
"11. The following fees shall be payable in advance-
For registration of an instrument of amalgamation or transfer | £40 |
For approval of a change of name | £3.50 |
For every inspection on the same day of documents kept by the Certification Officer under the 1964 Act relating to one and the same organisation | 50p.". |
5. For Regulation 12 of the principal Regulations there shall be substituted the following Regulation:-
"12. A fee of £5 shall be payable for the entry of an amalgamated organisation on the list of trade unions or employers' associations maintained by the Certification Officer under section 8 of the 1974 Act where each of the amalgamating organisations is already entered on the list.".

These Regulations, which come into force on 1st November 1978, increase the fees payable to the Certification Officer in connection with amalgamations and transfers of engagements between trade unions or unincorporated employers' associations, for the approval of changes of name by listed trade unions and employers' associations and for the inspection of documents.
