TERMS AND CONDITIONS OF EMPLOYMENT

The Lord Chancellor, in exercise of the powers conferred on him by section 129(2) and (5) of the Employment Protection Act 1975, hereby makes the following Order:-
1. This Order may be cited as the Employment Protection Act 1975 (Commencement No. 3) Order 1976.
2. The Interpretation Act 1889 shall apply to the interpretation of this Order as it applies to the interpretation of an Act of Parliament.
3. Sections 87 and 88 of the Employment Protection Act 1975 and Schedule 6 to that Act shall come into operation on 30th March 1976.
4. Where an appeal is transferred to the Employment Appeal Tribunal by virtue of paragraph 9 or 10 of Schedule 17 to the Employment Protection Act 1975 the Employment Appeal Tribunal shall have the same power to award costs in respect of that appeal as the High Court or the Court of Session, as the case may be, would have had if the appeal had not been so transferred.
5. Nothing in this Order or in the Employment Protection Act 1975 shall operate to transfer an appeal to the Employment Appeal Tribunal if the High Court or the Court of Session has, before 30th March 1976, entered upon the consideration of that appeal.

This Order brings into operation the provisions of the Employment Protection Act 1975 which establish the Employment Appeal Tribunal.
