The Secretary of State for the Environment in exercise of the powers conferred by paragraph 113 of Schedule 4 to the Coast Protection Act 1949 and now vested in him(1) and of all other powers enabling him in that behalf, hereby makes the following regulations:-
1. These regulations may be cited as the Coast Protection (Variation of Excluded Waters) Regulations 1975 and shall come into operation on 11th September 1975.
2. The Interpretation Act 1889 shall apply for the interpretation of these regulations as it applies for the interpretation of an Act of Parliament.
3. For paragraph 48 of Schedule 4 to the Coast Protection Act 1949 (which excludes part of Salcombe Harbour for the purposes of the definitions of sea and seashore in that Act) there shall be substituted the following, namely-
"48. At Salcombe-
(a)Batson Creek, above latitude 50° 14&min; 23&sec; North;
(b)Kingsbridge Estuary, above latitude 50° 14&min; 25&sec; North; and
(c)Southpool Creek, above longitude 3° 45&min; 17&sec; West".

Schedule 4 to the Coast Protection Act 1949 excludes certain waters for the purposes of definitions of "Sea" and "Seashore" in the Act, but provides that the Schedule may be varied either by adding waters to it or by removing waters from it.
These Regulations vary the Schedule by removing certain waters from it.
