DECISION
"45. In my judgment, on the tribunal's findings of fact, the Commissioners' decision not to restore was indeed disproportionate and therefore not one which they could reasonably have arrived at. It follows that on this issue the Tribunal came to the correct conclusion. Looking at their findings of fact, it is not difficult to see why.
The court also observed that Alzitrans had been deprived of the use of the vehicle for over 2 years.
