On a finding that a transport operation was a "front" for another, the Deputy Traffic Commissioner determined that the Transport Manager (the Appellant) must have known that was the case. He determined that she did, taking account of her previous history of having applied for a licence herself during which process she lied and was found to be a "front" for another. The issues in this appeal were whether the Deputy Traffic Commissioner was entitled to find that the Appellant knew that the operator was a "front" on the evidence; whether the Deputy Traffic Commissioner had properly evaluated the evidence; whether the period of disqualification ordered following loss of repute was disproportionate.
