Background to the appeal
Considering the provisions of sections 10(5) and 27(1) and (3) of the Social Security Act 1998 and Regulation 7(6) of the Social Security and Child Support (Decisions and Appeals) Regulations 1999, the effective date of the supersession is limited to the date of the Commissioner's decision on 9 November 2000 and cannot be backdated to 2 Mach 1995.
Grounds of appeal
Section 27
(3) In so far as the decision relates to a person's entitlement to a benefit in respect of -
(a) a period before the date of the relevant determination ...

it shall be made as if the adjudicating authority's decision had been found by
the Commissioner or court not to have been erroneous in point of law.
