Summary
A decision on costs in favour of the patentee in revocation proceedings where unconditional amendments had been proposed. Hearing officer found there to be no reason to depart from scale costs and considered the patentee-™s claim to be reasonable. Defendant argued that had the patentee agreed that the patent to be invalid and made amendments before initiating proceedings, the application to revoke may have been avoided. The hearing officer did not consider this justified a reduction in the costs claimed.
