The invention related to compensating for lack of gain flatness in a receiver or a transmitter by constructing a finite impulse response (FIR) filter, based on calculating gain flatness for a sequence of frequency points in a particular bandwidth and using a power of the centre frequency as a reference power. The examiner had argued that the application was insufficient because calculations were not based on the inverse of the frequency response but rather on the frequency response itself. The inverse would be needed in order to compensate for gain flatness. Following an observation by the examiner that there may be an error in one of the equations, the applicant requested that the application be corrected. The requested correction would resolve the sufficiency problem. The hearing officer decided that, taking into account a number of factors, the correction should be allowed. The sufficiency issue therefore fell away and the case was remitted to the examiner for further processing.
