Summary
A request that opinion 14/21 be set aside because the examiner had misconstrued claim 1 was rejected. Rather following the approach set out in DLP, the Hearing Officer found that the opinion had not by reason of its interpretation of the specification of the patent in suit, wrongly concluded that a particular act did not or would not constitute an infringement of the patent.
