Summary
The decision relates to a review of Opinion 13/20 which considered whether the patent, which relates to method of shaping profiles from a plane metal strip through the use of a production line, was infringed. The opinion concluded that there was no infringement. The proprietor of the patent however submits that the examiner has reached this conclusion only interpreting the claim in a manner that is clearly wrong.
The Hearing Officer, applying the principles set out in DLP, decided that the examiner had not by reason of how he had interpreted the specification of the patent, reached a conclusion on infringement that is clearly wrong. The opinion was therefore not set aside.
