Summary
The application relates to a way of improving the success of an email to a group of recipients by determining which of at least two test email messages is acted on more than the other by respective identified segments of the group, and sending this preferred email to a portion of the group. In particular, at least two test emails are sent to respective segments of the group and the preferred email from the test emails may then be sent to the remainder of the group.
The Hearing Officer applied the Aerotel/Macrossan test in light of Symbian and the signposts found in the AT&T/Cvon judgment. The Hearing Officer concluded that the contribution related solely to excluded matter as a business method and a computer program as such. The application was refused.
