Summary
This was an entitlement action that was withdrawn by the pursuer before the proceedings reached the evidence stage. The defender (patentee) was entitled to a contribution towards its expenses in the action.
The Hearing Officer was satisfied that there had been no “wider breaches of rules, delaying tactics or other unreasonable behaviour” on either side that would justify off scale expenses; he awarded expenses according to the standard scale.
