Summary
The opposition was based on a number of registrations of the mark STANDARD LIFE. The Section 5(2) objection was directed at some, only, of the goods specified in the application; the section 5(3) objection was directed at all of them. The Hearing Officer dealt firstly with Section 5(3) objection. The applicants had not provided any evidence concerning their choice of the mark, neither had they chosen to limit their specification. In the result the opposition under Section 5(3) succeeded. In case he should be found wrong in this, however, the Hearing Officer went on to consider the Section 5(2)(b) grounds, and in this he found the opponents successful in relation to the goods objected to.
