Summary
The proprietor of the patent, Mr Cunningham, requested a review under section 74B of the Patents Act of Opinion 11/06. That opinion had found that the patent was not infringed by a camera system produced by Nokia and also that claim 6 of the patent to be invalid.
The hearing officer, although construing claim 1 of the patent slightly differently to the Opinion, nevertheless decided that the Opinion was correct in its findings of non-infringement and invalidity of claim 6.
A request by Nokia that I refuse permission to appeal was rejected.
