Summary
Bloomberg had been granted two extensions of the period for compliance with the Patents Act and Rules, but had not yet filed the forms and fees required to make them effective. The patent application had been refused by the Office but this was being appealed to the court. The applicants requested an extension to the period of time for doing so until after final determination of the patent application by the courts as the extension of the period would only have relevance if the court found an amended version of the patent could be granted. The hearing officer held that this was not sufficient reason to grant an extension, and nor was the length of time the examination process had taken. He also held that the second extension could not have been granted under the Rules when the first extension had not been brought into effect. He extended the period of time for granting this second extension and granted it conditional on the first extension being brought into effect.
