Summary
The specification related to the transmission of video signals as sub-pictures with means to link the position of each sub-picture in a mosaic with its program number. The hearing officer held that an amendment to restrict the claims to include the transmission also of the number of horizontal and vertical pictures in the mosaic so as to avoid a specification lying in the section 2(3) field was neither explicitly or implicitly, as a matter of necessity, disclosed in the specification, but the amendment took this feature out of the context in which it had originally disclosed and therefore added matter (Palmaz [1999] RPC 47 followed).
