Summary
The claimant objected to the defendant introducing into evidence letters marked "Without prejudice". The hearing officer found that for material to be afforded privilege it must relate to negotiations conducted between the parties with the intention of settling the dispute. In the present case, the letters contained no such negotiation. Nor were they part of a sequence of communications which might involve negotiation. The fact that they were marked "Without prejudice" did not of itself afford them privileged status. The letters were admitted as evidence.
