Summary
The applications both relate to a method of manufacturing a coil characterised by a method of design which consists of a series of mathematical steps. Each is divided from an application directed to a coil per se. Objection was raised that the claims related in substance to a mental act and/or mathematical method.
Following CFPH LLCs Application [2005] EWHC 1589 Pat and Halliburton Energy Services Inc v Smith International (North Sea) Ltd and others [2005] EWHC 1623 Pat, it was held that the advance set out in the claims of both applications were mental acts and/or mathematical methods and therefore excluded from patentability under Section 1.
