Summary
The registered proprietor filed no counterstatement or evidence, the Registry issued a decision revoking the mark. The proprietor appealed to the Appointed Person, claiming that the mark had in fact been used. Very belatedly the parties informed the Treasury Solicitor’s Department that they had made an agreement for the mark to be assigned to the applicant for revocation, and asked that the Registry’s decision be set aside.
The Registry having no objection, and the dispute between the parties having abated the Appointed Person dealt with the matter in accordance with the procedure established by a previous case (BL O/567/01). The Registry’s decision was set aside by consent
