Summary
The application is one where the examiner has objected that the invention is excluded under section 1(2)(c) as being a method for doing business. In advance of the substantive hearing to decide that issue, the applicants argued that they had not been presented with a full and comprehensive analysis of the prior art upon which the examiner was basing his case that the invention made no technical contribution and thus were not able to put their case fully on that point.
Held that the prior art which the examiner was relying upon and how the invention differed from that prior art was clear from the correspondence when viewed in its entirety and thus that the case to be answered by the applicant was clear.
