Summary
The applicant successfully argued that the invention involved an inventive step over the prior art and met a long felt want by demonstrating commercial interest in the invention. However, certain issues of clarity and consistency had been deferred pending resolution of the inventive step objection such that the application could not be granted as it stood. Although the period allowed to put the application in order had expired, under Rule 110(3), the applicant had the right to extend that period by one month on payment of the requisite form and fee, should he wish to file further amendments. Mr Mann subsequently filed further amendments (plus Form 52/77 and fee) by the due date to put the application in order.
