Summary
In his decision dated 12 December 2000 (BL O/460/2000) the Hearing Officer found that the opponents failed on all their grounds of opposition. The opponents appealed to the Appointed Person but shortly thereafter abandoned their appeal. The applicants asked for costs.
The opponents claimed that the applicants would have incurred little costs because the appeal was abandoned long before a hearing was due. The applicants claimed in respect of handling the appeal, making enquiries about the availability of counsel and preparing draft instructions. In all the circumstances the Appointed Person agreed that the applicants should be awarded a reasonable sum to meet their costs and he awarded them the sum of £200.
