Comparison of the marks : 'TAYLOR OF LONDON' v 'TAYLOR MADE'
Summary
The opposition was based on the opponents’ registration of 'TAYLOR OF LONDON' in respect of identical goods. The opponents’ mark was first used in 1887 and had been in continuous use since then. The Hearing Officer however found no likelihood of confusion. This effectively decided the matter under Section 5(4)(a) also.
