  • 1. Comparison of the marks: JIGZAW and device v device of jigsaw pieces; impossible to refer to latter mark without using the word ‘jigsaw’.

Summary

The opposition was based on a number of registrations of the opponents’ marks, devices of jigsaw pieces. The Hearing Officer selected the opponents’ ‘best case’ in each of the classes applied for. He found the goods/services to be either similar or identical and went on to compare the marks. Having done so he concluded that there existed a likelihood of confusion and the opposition succeeded accordingly.
