Summary
The opposition was based on the opponents’ registrations of ‘PLAYSTATION’.
Having compared the marks, goods and services the Hearing Officer concluded that "on a global appreciation, notwithstanding that identical and similar goods and services are involved and that the customer would be the public at large, the overall differences in the respective marks are such that the average customer would not be likely to confuse the applicants marks with the opponents earlier registrations." The opposition failed accordingly.
